PLEASE READ CAREFULLY.  BY USING OUR FACILITIES, YOU WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO TAKE LEGAL ACTION, SEEK COMPENSATION FOR MEDICAL EXPENSES, OR CLAIM ANY RELATED COSTS. 

 

1. ASSUMPTION OF RISK 

By participating in any "Activities" (group classes, private classes, experiences, activities) I voluntarily choose to use the fitness and wellness facilities and equipment, participate in group and/or private fitness and wellness classes, including but not limited to Muay Thai, general fitness training, and water sports activities such as sailing, aqua fitness, paddle board (collectively referred to as “Activities”) organised by Dusit Thani Krabi Beach Resort ("Hotel"). I understand and acknowledge that these Activities involve inherent risks, including but not limited to physical exertion, muscle strain, falls, collisions, equipment failure, exposure to water, drowning, unpredictable weather conditions, and other risks that could result in injury, illness, disability, or death. I confirm that I am physically fit, in good health, and have no medical condition that would make my participation unsafe. I assume full responsibility for any risks, injuries, or damages that I may incur due to my participation in these Activities, whether caused by my actions, the actions of others, or conditions at the Hotel. 

 

3. Emergency Medical Authorisation 

In the event of a medical emergency, I authorise hotel associates and/or medical personnel to administer first aid and, if necessary, life-saving procedures such as CPR / EAD. I also grant permission for the associates to contact the emergency contact provided on this form and to seek further medical assistance as deemed appropriate. I understand that these actions are taken in good faith and in the best interest of my health and safety. 

 

4. RELEASE AND WAIVER OF LIABILITY 

I, on behalf of myself, my heirs, executors, administrators, and legal representatives, hereby waive, release, and discharge Dusit Thani Krabi Beach Resort, Dusit Thani Public Company Limited, MBK Public Company Limited, their affiliates, owners, directors, officers, employees, instructors, trainers, agents, insurers, and representatives (collectively, the “Released Parties”) from any and all claims, demands, damages, losses, liabilities, costs, or expenses, including those arising from negligence or breach of duty, related to my participation in the Activities. I further agree that I will not sue or bring any claims against the Released Parties for any injury, damage, or loss that may arise out of or in connection with my participation in the Activities, including but not limited to those caused by accidents, negligence, improper use of equipment, or unforeseen circumstances. 

 

5. INDEMNIFICATION 

I agree to hold harmless and indemnify the Released Parties from any claims, losses, damages, or expenses (including medical expenses, travel costs, and legal fees) arising from my participation in the Activities, including those caused by my own negligence or failure to follow safety guidelines provided by the Hotel's trainers, instructors, or employees. I acknowledge and accept that the employee, instructor or coach conducting my private classes may not hold any formal certification or professional training to conduct the private class, and I voluntarily assume any risks associated with this. 

 

6. SAFETY AND COMPLIANCE 

I agree to follow all rules, regulations, safety instructions and guidelines provided by the instructors, trainers, and Hotel employees. I acknowledge that failure to comply with safety rules and guidance may increase the risk of injury or result in my removal from the Activities without any refund or compensation. 

 

7. GOVERNING LAW AND JURISDICTION 

This Release shall be governed by and construed in accordance with the laws of Thailand. Any disputes arising from or related to this Release shall be exclusively settled in the competent courts of Thailand. 

 

8. SEVERABILITY 

If any provision of this this content is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. 

 

9. ACKNOWLEDGMENT AND VOLUNTARY ACCEPTANCE 

By using our facilties and or taking part in any activities, you agree that you have read this Terms & Conditions, this Waiver of Claims, and Assumption of Risk Agreement in its entirety. I fully understand its contents and agree to particiate in any "Activity" voluntarily, without coercion or undue influence. I acknowledge that by agreeing I am waiving certain legal rights, including the right to sue the Released Parties in the event of an injury, accident, or loss. 

 

All policies, terms and conditions remain valid for all “Activities” I participate at Dusit Thani Krabi Beach Resort, including multiple group or private sessions or classes (“Activities”) as well as the use of all fitness and wellness facilities.
